What is a Crypto-asset service provider (CASP)?

MiCA defines “crypto-asset service provider” or “CASP” as a legal person or other undertaking whose occupation or business is the provision of one or more crypto-asset services to clients on a professional basis, and that is allowed to provide crypto-asset services.

A crypto-asset service provider (CASP) is:

  1. a legal person or other undertaking;

  2. whose occupation or business is the provision of one or more crypto-asset services to clients;

  3. on a professional basis; and

  4. that has been allowed to provide crypto-asset services in accordance with Article 59 of the Regulation on Markets in Crypto-Assets (MiCA).

A CASP may provide one or more of the crypto-asset services hereafter and are organised into 3 different classes/categories (Annex IV MiCA, incoherent with Recital (21) MiCA):

  • CASP Class 1 (Annex IV) - CASP authorised for the following crypto-asset services:

  • CASP Class 2 (Annex IV) - CASP authorised for any crypto-asset services under Class 1 and :

  • CASP Class 3 (Annex IV) - CASP authorised for any crypto-asset services under Class 2 and:

    • operation of a trading platform for crypto-assets.

Captions of the Services acronyms:
• EVA-C the exchange between virtual assets and fiat currencies, including the service of exchange between virtual currencies and fiat currencies (Luxembourg AML Law), equivalent to exchange of crypto-assets for funds (MiCA);
• EVA-VA the exchange between one or more forms of virtual assets (Luxembourg AML Law), equivalent to exchange of crypto-assets for other crypto-assets (MiCA);
• TVA the transfer of virtual assets (Luxembourg AML Law), equivalent to providing transfer services for crypto-assets on behalf of clients (MiCA);
• SAVAI the safekeeping or administration of virtual assets or instruments enabling control over virtual assets, including the custodian wallet service (Luxembourg AML Law), equivalent to providing custody and administration of crypto-assets on behalf of clients (MiCA);
• FSVA the participation in and provision of financial services related to an issuer’s offer or sale of a virtual asset (Luxembourg AML Law), equivalent to operation of a trading platform for crypto-assets (MiCA).
